Restrictions to the Freedom of Speech

Freedom of speech is not an absolute right nor does it exist in its absolute sense anywhere in the world. Governments, laws, organisations, and public opinion have always placed restrictions on free speech.

Legal Constraints to free speech in the United Kingdom:

The Human Rights Act Article 10: Freedom of Expression – under Article 10 everyone has the right of freedom of expression. However, the exercise of these freedoms is limited: “The exercise of these freedoms… may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society…”

The Official Secrets Act 1989 – makes the disclosure of confidential material from government sources by employees a criminal offence. There is no public-interest defence, and disclosure of information already in the public domain is still a criminal offence.

The Serious Organised Crime and Police Act 2005 – protest without permit within a 1km radius of Parliament. The first conviction under the Act was in December 2005 when Maya Evens was convicted for reading the names of British soldiers and Iraqi civilians killed in the Iraq War.

Libel & Slander Laws – seek to prevent defamatory statements of an individual in writing and speech. Jeffrey Archer successfully sued for libel in 1987 over claims in the Daily Star that he had had sex with a prostitute. He was awarded £500,000 in damages.

Data Protection Act 1884 – places restrictions on communicating personal data with third parties.

Public Order Act 1986 – prohibits certain acts intended or likely to stir up racial hatred including the use of words or behaviour or displays of written material which are threatening, abusive or insulting and intended to stir up racial hatred.

Obscene Publications Act 1959 – makes commercial dealings in obscene items, or possession of them a criminal offence. With or without a prosecution, the items can be seized under a magistrate's warrant and, after a hearing to determine whether they contravene the statute, can be forfeited.

Protection of Children Act 1978 – makes it a criminal offence to take, permit to be taken or make; to distribute or show; to have in one's possession with a view to distribution or showing by oneself or others; an indecent photograph or psuedo photograph of a child.

S.43 Telecommunications Act 1984 – makes it an offence to send by a public telecommunications system a message or other matter that is grossly offensive or of an indecent, obscene or menacing character.

Blasphemy Laws – seeks to restrict hateful literature being published that is "reviling", "scurrilous" or even "ludicrous matter" relating to Christian concepts. The specifically relate to the Christian God, Jesus Christ, the Christian Bible or the Christian Book of Common Prayer.

Examples of governments and organisations restricting free speech.

The FBI has ordered an ISP to stop distributing the unedited video of journalist Daniel Pearl being brutally murdered.
The well known alternative news publication YellowTimes org was just shut down without explanation by its hosting company! It recently published an article by an Iraqi nuclear scientist, Law & Policy of Computer Communications, February 10, 2003
Yahoo apparently removed 55 "jihad-related" sites, Wall Street Journal / MSNBC, October 8, 2001 without any restrictions or judicial supervision.
Harvard University's English department has cancelled a lecture planned by Tom Paulin, an award-winning poet and professor at the University of Oxford, after complaints from students and faculty members about Mr. Paulin's political views, particularly his harsh critiques of Israel, Chronicle, November 13, 2002.
Tim McCarthy is the editor of the Courier, a weekly newspaper in Littleton, New Hampshire, owned by Salmon Press. Last year, he won the "Editorial Writer of the Year" award from the New Hampshire Press Association, and previously he'd won that award from the New England Press Association. But on February 13, he was fired. McCarthy cites two factors in his dismissal: His repeated editorializing against George W. Bush's recklessness, and his defense of a cartoonist who was under the gun for a controversial panel criticizing the President.
A substitute teacher filed a federal lawsuit Wednesday, saying his school district violated his free speech rights for remarks he made that were perceived as supportive of Osama bin Laden. John B. Gardner, 52, of Stanton Heights, was suspended Sept. 20, 2001, after he wrote phrases in a newspaper margin that he said were related to a book he was writing on how to overcome adversity. He was later reinstated. One of the phrases read: "Osama bin Laden did us a favour ... He vulcanized us, awakened us and strengthened our resolve." Another said, "We're going to be stronger because of it".
I thought i'd dedicate this months topics and discussion to the concept of freedom, and freedom of speech in particular! not everything i post up on here i agree with, many on the contrary.

I know ramadan is over...but this article a dear friend has written is still just as applicable!...it should be taken as amessage about unity even outside ramadan.


Brotherhood and unity in Ramadhan
As the beautiful month of Ramadan has graced us with it’s arrival, Muslim’s near and afar have begun celebrating this month of heightened devotion for Allah (swt).
A month where the gate of mercy are wide open, the gates of hell are shut and the shaytaan is chained up. it is a month favoured over all other months where millions of muslims all over the world are in contemplation and in complete devotion in their one lord.
"Oh, you who believe! Fasting is prescribed to you as it was prescribed to those before you, that you may gain Taqwa"(2:183)
Just as the verse of the Quran say’s, we fast to attain "God-consciousness" thus meaning bringing us closer to Allah(swt).
So Allah(swt) has allowed each and everyone of us to witness once again the month of Ramadan, that we may benefit from it, by making sincere repentance, seeking Allah’s mercy and forgiveness, praise Allah(swt) who gave us life and all that we have in this life. It is a period of intense reflection, devotion and seeking guidance.
It is a time where shops and restaurants stop selling alcohol. Hijabs and jubas are worn, students are xtra careful to avoid the opposite sex.
We try to avoid backbiting telling lies. But why do we do these actions strictly in the month of Ramadan? Let us ask ourselves is islam for just one month of the year? And are we relieved of our duties to allah swt for the rest of the year?
"Fasting is a shield with which a servant protects himself from the fire"

Ramadan is an opportunity to develop qualities of endurance and self-restraint, to control anger and a fiery malicious tongue. It is a time to awaken compassion and solidarity with others, rich, poor, near or far.
The Messenger of Allah (may Allah bless him and grant him peace) addressed his companions on the last day of Sha`ban, saying, "Oh people! A great month has come over you; a blessed month; a month in which is a night better than a thousand months; month in which Allah has made it compulsory upon you to fast by day, and voluntary to pray by night. Whoever draws nearer (to Allah) by performing any of the (optional) good deeds in (this month) shall receive the same reward as performing an obligatory deed at any other time, and whoever discharges an obligatory deed in (this month) shall receive the reward of performing seventy obligations at any other time. It is the month of patience, and the reward of patience is Heaven. It is the month of charity, and a month in which a believer's sustenance is increased. Whoever gives food to a fasting person to break his fast, shall have his sins forgiven, and he will be saved from the Fire of Hell, and he shall have the same reward as the fasting person, without his reward being diminished at all." [Narrated by Ibn Khuzaymah
Abu Umamah reported: "I came to the Messenger of Allah and said: 'Order me to do a deed that will allow me to enter Paradise.' He said: 'Stick to fasting, as there is no equivalent to it.' Then I came to him again and he said: 'Stick to fasting."' [Ahmad, an-Nasa'i, and al-Hakim]
In another hadith, the Messenger of Allah (May Allah bless him and grant him peace) says, "Ramadhan has come to you. (It is) a month of blessing, in which Allah covers you with blessing, for He sends down Mercy, decreases sins and answers prayers. In it, Allah looks at your competition (in good deeds), and boasts about you to His angels. So show Allah goodness from yourselves, for the unfortunate one is he who is deprived in (this month) of the mercy of Allah, the Mighty, the Exalted." [Tabarani]
So let us take this saying of our beloved prophet(saw) and work harder to attain Allah’s (swt) pleasure and gain more reward by partaking in Suhur, inviting your Muslim brothers and sisters to break fast with you and your families. Let us maintain strong bonds of Brotherhood, give favour over their needs before our own thus allowing us to abandon the act of possessiveness and selfishness, so being generous and sharing becomes more favourable to do. Show compassion and caring. Your guests, they too have fasted, no food no water has passed their lips also.
To maintain our brotherhood and unity we must abstain from mentioning faults of another whether in their absence or on their presence. Let us be kind in our words and promote the goodness of an other Muslim, for Allah (swt) knows all. Praise where you can give pleasure of a compliment especially when your sister or brother has made extra effort with love your favourite dish for iftar. Be a source of honour, affection and respect. Ramadan gives us a chance to forgive, ask forgiveness of our mistakes and failings. It is better to be humble.
It is also a time for us to reflect on not only on issues that will inshallah save ourselves from hellfire but to contemplate on our responsibilities towards our dear brothers and sisters around the world.
There was a city where bad people and evil actions were taking place. Allah said to the angels, "go destroy that city". The angels went to obey their orders, but just as they were about to start they saw a man praying. They went back to allah and explained that there is man in the city that stays in his house all day and night praying to Allah, and so they didn’t destroy the city. Allah swt said" did the mans face not even turn red with anger at what is happening around him". So he ordered the angels to kill him first.. Hadith Qudsi
This hadith shows us how dangerous it is for us to be content with perfecting ourselves and not being concerned about what is going on around us .
Rammadan’s not about just increasing our ibadat it is also about brotherhood. In this month allah swt brings us closer together as an ummah as one unit.
" Believers are but brothers, so set things right between your brothers and observe your duty to Allah(swat) so that you may obtain mercy"(49:10)
The Quran is our guidance. It is ours to learn, from each other, to understand and implement in our lives not only in Ramadan but also for the months that follow.
stand side by side at Taraweeh, on the night of Al-Qadr. Pray for each other, pray for the living near to you and in far away lands. Pray for those who have passed away, pray for them and their families as you would for your own. Prayers for the deceased are on the same footing as a gift for the living, the dead delights and rejoices in such a gift.
Be loyal and sincere, be steadfast in your love for one another just as your fast in Ramadan.
Finally as we pay our zakat, give Sadaqa in this wonderful month and we try to relieve the discomforts and inconveniences not only for our neighbours but for our fellow Muslims in far away lands. Let us work hard to gain Allah’s (swt) pleasure so we can remove the wrongs that have been afflicted on them.
Salahuddin Ayyubbi who took his army to battle during the month of Rammadan in 1187 AD so as to free the muslims from the crusaders. Why ? because he understood these were his brothers and sisters who were need of help.
let us make this month of Ramadhan, the month of prayer, the month of worship, the month of recitation of Qur’an, the month of giving Zakat, the month of strengthening the relations between our relatives, the month of generosity and goodness to the needy, the month of being aware of our speech and actions, the month of re-invigorating our Iman and purifying our hearts and the month of engaging in the da’wa to bring the implementation of the Quran on the earth.
Remember Islam is our guidance, our light in our lives. Let us maintain the acts of Brotherhood, unity and virtues of Ramadhan daily even in the months that follow.
The Prophet( saw) said that ‘the ummah is one body, if one part of the body aches then the rest of the body shakes in pain and fever.’
Let this sensational month never end so we may always be gaining Allah’s (swt) pleasures and rewards.
DUA
Oh Allah! Make the Qur’an al-Kareem, a pleasure for our hearts, the light of our sight and the banishment of our sorrows and a lifting away of our worries.
Oh Allah! Teach us from it what we were ignorant of, and remind us of it what we have forgotten, and provide us with the ability to recite it throughout the day and the night.
Oh Allah! Make us from this who maintain the Halal as the Halal and the Haram as the Haram, and recite it as it truly is.
Oh Allah! Make it a guide for us in our lives, and accompany us in our graves, which become a veil for us from the fire, and a guide for us to the path of Jannah.
And may peace be upon our Master, the Messenger (saw), and upon his family and companions, and those who follow him with the best of blessings until the day of Judgement.

This is an old letter, neverthe less i came across it recently and thought whoever hasnt read it definitly should!....the reality has not changed!

A Letter from Abu Ghraib
The following is a letter from the Abu Ghraib prison. Fatima's letter, a hand written document, was recently smuggled out of Abu Ghraib. Fatima is the sister of one of the celebrated Resistance fighters in the area. US occupation forces raided his house some time back but failed to find him, so they took his sister prisoner in an attempt to force him to give himself up. Here is Fatima's letter as originally published in Arabic by Mafkarat al-Islam and translated to English by Muhammad Abu Nasr of Free Arab Voice.
Fatima's Letter
In the name of God, the Merciful, the Mercy-giving. "Say He is God the One; God the Source [of everything]; Not has He fathered, nor has He been fathered; nor is anything comparable to Him." [Qur'an, Surat 112 "al-Ikhlas"]
I chose this noble Surah from the Book of God because it has the greatest impact on me and on all of you and it strikes a particular kind of awe in the hearts of Believers.
My brother Mujahideen in the path of God! What can I say to you? I say to you: our wombs have been filled with the children of fornication by those sons of apes and pigs who raped us. Or I could tell you that they have defaced our bodies, spit in our faces, and tore up the little copies of the Qur'an that hung around our necks? God is greatest! Can you not comprehend our situation? Is it true that you do not know what is happening to us? We are your sisters. God will be calling you to account [about this] tomorrow.
By God, we have not passed one night since we have been in prison without one of the apes and pigs jumping down upon us to rip our bodies apart with his overweening lust. And we are the ones who had guarded our virginity out of fear of God. Fear God! Kill us along with them! Destroy us along with them! Don't leave us here to let them get pleasure from raping us! It will be an act to ennoble the Throne of Almighty God. Fear God regarding us! Leave their tanks and aircraft outside. Come at us here in the prison of Abu Ghurayb.
I am your sister in God (Fatimah). They raped me on one day more than nine times. Can you comprehend? Imagine one of your sisters being raped. Why can't you all imagine it, as I am your sister. With me are 13 girls, all unmarried. All have been raped before the eyes and ears of everyone.
They won't let us pray. They took our clothes and won't let us get dressed. As I write this letter one of the girls has committed suicide. She was savagely raped. A soldier hit her on her chest and thigh after raping her. He subjected her to unbelievable torture. She beat her head against the wall of the cell until she died, for she couldn't take any more, even though suicide is forbidden in Islam. But I excuse that girl. I have hope that God will forgive her, because He is the Most Merciful of all.
Brothers, I tell you again, fear God! Kill us with them so that we might be at peace. Help! Help! Help! [Wa Mu'atasima!]
The dispathes debate on ch4 , presented by jon snow..."Are muslims threatening freedom of speech?"
Many of us are aware that recently muslims are under attack for being over sensitive and continiously on the defensive, just some examples would be when the cartoons of the prophet were published, or recent comments on what the pope said about our beloved prophet muhammad saww.
ive just finished watching a debate on channel 4, where the audience was able to cast their vote on what they believed. the question was Are muslims theraetening freedom of speech? the results of the vote was
52% said NO, and 48% said yes.
the interesting bit is the 48% who believed muslims were in, other words 'fussy'... and intolerant. so yes everyone has a right to insult muslims and islam, but muslims don't have aright in any way to react or defend our deen... like someone said "You kick me and then you tell me how to react to that kick!"...doesn't make sense.
so basically my question is Are muslims threatening freedom of speech?
well i thought to myself, theres no doubt that the concept of freedom of speech does exist in a democracy, and going further people do have the right to insult others and their belief!
surely as muslims doesn't the concept of freedom of speech just SUCK? and the crux of the question is there a concept of freedom of speech in islam?
